1. Overview

This website is operated by Beringer Sport Ltd. Here forth referred to as Beringer. Throughout the site, the terms “we,” “us,” and “our” refer to Beringer.

By visiting our website, purchasing a product, or using any part of our services, you agree to these Terms of Service, our Final Sale, Return & Refund Policy, Shipping Policy, and Privacy Policy.

If you do not agree to these terms, you must not use this website or purchase our products.

2. Eligibility

You must be at least the age of majority in your province, state, or country of residence, or have the permission of a parent or legal guardian, to make a purchase through this website.

You agree to provide accurate, current, and complete account, billing, shipping, and payment information.

3. Products and Product Information

We make reasonable efforts to display product descriptions, specifications, compatibility information, colours, and images accurately.

Actual colours and appearance may vary depending on lighting, photography, screen settings, manufacturing variations, and other factors.

Product information may be updated or corrected without notice. We reserve the right to discontinue products, limit quantities, or restrict sales to any person, region, or jurisdiction.

Customers are responsible for reviewing all product information and confirming that the selected product is suitable for their intended use before placing an order.

4. Prices and Payments

All prices are shown in the currency displayed at checkout and may change without notice.

Applicable taxes, shipping charges, duties, brokerage fees, and other charges will be displayed or assessed where applicable.

We reserve the right to correct pricing, product, inventory, or promotional errors. If an error affects an order already placed, we may contact the customer to confirm the corrected order or cancel the affected order and issue any refund required.

5. Orders

Submitting an order does not guarantee acceptance. We may refuse, limit, or cancel an order for reasons including:

• Product availability.

• Incorrect pricing or product information.

• Suspected fraud or unauthorized payment activity.

• Shipping restrictions.

• Orders placed for unauthorized resale.

• Errors in customer or delivery information.

If we cancel an order after payment has been collected, we will refund the cancelled amount to the original payment method.

6. Final Sale

All purchases are final sale. We do not accept returns, exchanges, or refunds for change of mind, incorrect product selection, compatibility issues, colour preference, or customer ordering errors.

Exceptions apply only when required by law or when a product arrives damaged, has a verified manufacturing defect, or differs from the product ordered.

Complete conditions and claim procedures are provided in our Final Sale, Return & Refund Policy, which forms part of these Terms.

7. Order Changes and Cancellations

Orders cannot be changed or cancelled after they enter processing.

Customers should contact Beringer by way of the contact form at the bottom of the page immediately after placing an order if they identify an error. We will try to assist before processing begins, but changes or cancellations are not guaranteed.

8. Shipping and Delivery

Orders are prepared and shipped from British Columbia, Canada.

Delivery dates and transit times are estimates only and are not guaranteed. Delays caused by carriers, customs, weather, service interruptions, incorrect addresses, or events outside our reasonable control are not the responsibility of Beringer.

Risk of loss or damage transfers as provided by applicable law and the selected carrier’s terms.

Customers must provide complete and accurate delivery information. Additional costs caused by an incorrect or incomplete address may be charged to the customer.

Nothing in this section limits any cancellation or refund rights that cannot legally be excluded, including applicable rights relating to delayed or undelivered online orders.

9. Customs, Duties, and Import Charges

International orders, including orders shipped to the United States, may be subject to customs duties, import taxes, brokerage fees, or other charges imposed by the destination country.

The customer is responsible for these charges unless expressly stated otherwise at checkout.

Refusing or abandoning a shipment because of unpaid customs or import charges does not create a right to a refund. Any related charges billed to Beringer may be deducted from any amount otherwise required to be refunded, where permitted by law.

10. Product Inspection and Claims

Beringer inspects products before shipment. This inspection does not exclude defects that were not reasonably detectable or any rights available under applicable law.

Claims involving damaged, defective, or incorrect products must be submitted by way of the contact form within 7 calendar days of delivery, together with the information and photographs required by our Final Sale, Return & Refund Policy.

If a claim passes the preliminary review, Beringer may provide a prepaid shipping label and return authorization so the product can be returned for physical inspection.

A return authorization or prepaid shipping label does not constitute approval of a refund, exchange, or replacement. The final decision will be made only after Beringer receives and inspects the returned product.

All claims and available remedies remain subject to our Final Sale, Return & Refund Policy and applicable law.

11. No Additional Commercial Warranty

Unless a written warranty is expressly included with a product or displayed on its product page, Beringer does not provide an additional voluntary or commercial warranty.

This provision does not exclude or limit warranties, conditions, rights, or remedies that cannot legally be excluded under applicable consumer-protection law.

12. Product Use and Safety

Motorsports, mountain biking, enduro riding, motocross, and similar activities involve inherent risks of property damage, serious injury, and death.

Beringer's products are intended to supplement appropriate protective equipment and responsible riding practices. Goggles do not eliminate all risks and are not a substitute for a properly fitted helmet, other required safety equipment, appropriate training, sound judgment, or compliance with applicable rules and laws.

Customers are responsible for:

• Selecting products appropriate for their activity and conditions.

• Inspecting products before every use.

• Following all fitting, installation, cleaning, care, and replacement instructions.

• Discontinuing use if a product is damaged, excessively worn, altered, or no longer fits correctly.

Products must not be modified or used for a purpose for which they were not designed.

13. Intellectual Property

All website content, including the Beringer name, logos, product designs, patented features, photographs, videos, graphics, text, and other materials, is owned by or licensed to Beringer and is protected by applicable intellectual-property laws.

No content may be copied, reproduced, modified, distributed, published, sold, or commercially exploited without prior written permission.

14. Prohibited Uses

You may not use the website or its content:

• For unlawful, fraudulent, or misleading purposes.

• To violate intellectual-property rights.

• To transmit malicious software or harmful code.

• To interfere with website security or operation.

• To collect personal information without authorization.

• To place fraudulent orders or conduct unauthorized resale activity.

• To impersonate another person or misrepresent your identity.

We may suspend or terminate access for prohibited activity.

The website may contain links to or use services provided by third parties, including Shopify, payment processors, shipping carriers, and social-media platforms.

We are not responsible for the content, availability, policies, or practices of third-party websites or services. Use of third-party services may be subject to their own terms and policies.

By using the website, you acknowledge that online transactions require information to be transmitted through third-party networks and service providers.

To the fullest extent permitted by applicable law, the website and its content are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, secure, or error-free.

Product descriptions and general website content are provided for informational purposes and do not constitute professional safety, medical, or legal advice.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Beringer and its owners, employees, representatives, contractors, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or products.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including applicable liability for defective products, fraud, gross negligence, or rights protected by consumer law.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Beringer from claims, losses, liabilities, and reasonable expenses resulting from your unlawful use of the website, violation of these Terms, infringement of another person’s rights, or misuse or unauthorized modification of a product.

20. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted or removed as necessary. The remaining provisions will continue in effect.

21. Termination

We may suspend or terminate access to the website if you violate these Terms. Obligations and liabilities incurred before termination will survive termination where applicable.

22. Governing Law

These Terms and any separate agreements through which Beringer provides products or services are governed by the laws of British Columbia and the applicable federal laws of Canada.

This choice of law does not remove any mandatory consumer rights available to customers in their place of residence.

23. Changes to These Terms

We may update these Terms by publishing a revised version on this website. Changes take effect when posted unless otherwise stated.
